àBy€its€terms,€ðð€409(c)€of€the€PRA€limits€the€scope€of€theÏmore€general€waiver€of€sovereign€immunity€contained€in€ðð€401(1).€ÏFor€state€tort€claims€arising€out€of€the€activity€of€the€PostalÏService,€ðð€409(c)€compels€the€application€of€the€FTCA€and€itsÏattendant€provisions.€€Read€in€context,€then,€ðð€409(c)€of€the€PRAÏis€best€understood€to€waive€the€immunity€from€suit€that€the€PostalÏService€would€otherwise€enjoy€as€a€federal€entity€only€insofar€asÏthat€immunity€would€have€been€waived€under€the€FTCA.€€Such€aÏreading€accords€with€the€language€in€28€U.S.C.€ðð€2679(a)€providingÏthat€for€claims€that€fall€within€the€purview€of€the€FTCA,€claimsÏagainst€sue„and„be„sued€agencies€are€to€be€treated€like€a€claimÏagainst€any€other€federal€agency.€€Two€distinct€avenues€forÏinterpreting€ðð€409(c)€both€arrive€at€this€conclusion.Ìà Ðcompelled€by€ðð€2679(a),€and€its€exceptions,€as€provided€in€ðð€2680.€ÏOn€this€approach,€the€question€becomes€simply€whether€the€claimÏpresented€is€a€state€tort€claim€"arising€out€of€the€activities€ofÏthe€Postal€Service"€under€ðð€409(c).€€If€so,€then€the€claim€isÏgoverned€by€the€FTCA€as€a€whole,€including€its€exception€ofÏdefamation€and€interference€claims€from€its€waiver€of€sovereignÏimmunity.Ìà àDavric€argues€that€once€the€claim€falls€outside€the€scopeÏof€the€FTCA's€waiver€of€sovereign€immunity,€it€then€must€fall€backÏwithin€the€ambit€of€the€PRA's€more€general€waiver.€€The€best€basisÏin€the€statutory€language€for€this€claim€is€the€introduction€to€theÏexceptions€provision,€which€states€that€the€provisions€of€the€FTCAÏ"shall€not€apply"€to€defamation€suits.€€òòSeeóó€28€U.S.C.€ðð€2680.€€IfÐ Ðthe€FTCA€shall€not€apply€to€defamation€claims,€Davric€says,€thenÏdefamation€claims€are€not€cognizable€under€the€FTCA€and€hence€theÏgeneral€waiver€of€immunity€in€the€PRA€applies.€€However,€attentionÏto€the€remainder€of€ðð€2680€makes€clear€that€this€reading€is€notÏtenable.€€Section€2680(b)€excepts€any€claim€"arising€out€of€theÏloss,€miscarriage,€or€negligent€transmission€of€letters€or€postalÏmatter"€from€the€FTCA's€waiver€of€sovereign€immunity.€€FollowingÏDavric's€proposed€construction€of€the€statutory€scheme,€thisÏprovision,€ðð€2680(b),€would€be€rendered€mere€surplusage,€as€suitsÏagainst€the€Postal€Service€for€loss€of€postal€matter€could€thenÏsimply€be€brought€under€the€PRA's€waiver€of€sovereign€immunityÏrather€than€under€the€FTCA.€€Since€this€outcome€is€not€conceivablyÏwithin€Congress's€intent,€Davric's€suggested€construction€of€theÐ Ðthe€scope€of€his€employment€in€the€avalanche€of€derogatory€commentsÏhe€directed€at€Plaintiffs"€and€in€the€"series€of€highly€defamatoryÏcharges"€he€directed€at€plaintiffs,€"made€in€a€very€angry€fashion."€Ïò òó óHowever,€even€if€true,€the€mere€fact€that€Leonti€made€statementsÐ 0€  Ðthat€were€defamatory€does€not€render€his€actions€outside€the€scopeÏof€employment.€€Plaintiffs€place€particular€emphasis€on€the€allegedÏstatement€by€a€senior€Postal€Service€official€to€Leonti€in€regardÏto€one€of€the€defamatory€statements€that€he€was€"on€his€own€on€thatÏone."€€Again,€even€if€true,€the€fact€that€the€Postal€Service€didÏnot€endorse€all€of€Leonti's€opinions€as€expressed€does€not€renderÏthe€statements€outside€the€scope€of€employment.ñ € Ð  Ðdistribution€center.€€He€was€at€a€meeting€of€Postal€ServiceÏemployees€called€during€work€hours€and€at€work€for€the€purpose€ofÏexplaining€the€Postal€Service's€site€selection€process.€€While€someÏof€Leonti's€statements€may€have€amounted€to€defamation,€DavricÏprovides€no€reason€to€believe€that€the€statements€did€not€further,Ïand€were€not€intended€to€further,€the€Postal€Service's€purposes€inÏjustifying€its€site€selection€process€to€its€own€employees.€€òòCf.óóÐ ÐRestatement€(Second)€ðð€228(1)(c).€€Actions€taken€in€the€workplaceÏto€serve€the€purposes€of€the€employer€are€prototypical€actionsÏwithin€the€scope€of€employment€under€the€Restatement€principlesÏoutlined€above.€€Ìà àNor€is€Davric's€argument€that€discovery€was€necessaryÏavailing.€€Davric€does€not€say€what€facts,€if€discovered,€wouldÏlead€to€a€viable€theory€that€Leonti€was€acting€outside€of€the€scopeÏof€employment.€€Indeed,€the€only€specific€facts€on€which€DavricÏindicates€it€sought€discovery€were€already€alleged€in€theÏcomplaint,€and€do€not€undermine€the€determination€that€Leonti€wasÏacting€within€the€scope€of€his€employment.ñ
