Ðspaces;€they€bear€the€logos€of€both€Danielson€and€TellalianÐ ° ÐAssociates.€ò òó ó€The€fourth€is€an€unlabelled€artist's€rendering€of€theÐ \¬ Ðbuildings€(designated€A„3).€€ò òó óNone€of€these€drawings€had€a€copyrightÐ X Ðnotice€on€them.Ð ´  Ðà ` àAt€the€time,€the€site€was€not€zoned€for€residentialÐ ` ° Ðdevelopment€ò òó óand€was€covered€by€a€restrictive€covenant€between€aÐ  \  Ðprevious€owner€and€the€Town€of€Winchester€(the€"Town").€ò òó ó€TheÐ ¸  Ðcondominium€plan€could€only€be€completed€if€both€the€zoning€and€theÐ d´  Ðcovenant€were€amended,€and€only€the€Winchester€Town€Meeting€couldÐ `  Ðapprove€either€change.€€ò òó óOn€June€11,€1987€„„€the€same€date€that€isÐ ¼ Ðdormant€until€1994.€€ò òó óDanielson€has€never€collected€over€$226,000Ð ° Ðthat€Farese€owes€it€for€work€completed€under€the€contract.ò òó óÐ \¬ Ðâ âà ` àIn€1993,€Robert€Pace€became€interested€in€buying€andÐ X Ðdeveloping€the€site.€€ò òó óHe€formed€WCP€and€acquired€the€site€in€aÐ ´  Ðforeclosure€sale€in€April€1994.׃×Ý ƒ#ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×€€ò òó óOver€the€next€few€months,€WCPÐ ` ° Ðconsidered€a€range€of€possible€development€options,€includingÐ  \  Ðtownhouses,€single„family€homes,€and€housing€for€the€elderly.€Ð ¸  ÐSeveral€versions€of€a€condominium€plan€like€the€one€Farese€hadÐ d´  Ðpursued€were€also€"on€the€table."€ò òó ó€Representatives€of€WCP€met€threeÐ `  Ðtimes€in€mid„1994€with€Edmond€Danielson,€by€then€the€only€full„timeÐ ¼  Ðarchitect€at€the€Danielson€firm,€to€discuss€ideas€for€the€site.€€AtÐ h¸ ÐEdmond€Danielson's€suggestion,€Donald€Tellalian€joined€the€secondÐ d Ðand€third€of€these€meetings.€€The€WCP€representatives€brought€theÐ À Ðdisputed€drawings€to€these€meetings€and€the€participants€looked€atÐ l¼ Ðthem,€but€WCP€expressed€concern€that€Farese's€plan€would€not€beÐ h Ðprofitable.€ò òó Ðsays€he€was€unaware€of€WCP's€intent€to€use€the€old€design€untilÐ ° ÐAugust€1997,€when€one€of€the€firm's€former€employees€happened€toÐ \¬
