Court Operations During Government Shutdown
The United States Court of Appeals for the First Circuit will continue operations during any government shutdown caused by the failure to enact an annual appropriation bill or a continuing resolution. The court will continue to docket new cases, receive documents for filing, determine motions, hear oral argument, and decide cases. All of the cases currently calendared for oral argument during the October 2-5 Sitting will go forward as scheduled. Federal government attorneys are expected to appear for oral argument despite any lapse in appropriations or shutdown.

Because the court will remain open for business during any shutdown, filing dates will not be automatically extended. Parties remain obligated to comply with the filing requirements of the Federal Rules of Appellate Procedure and this court’s Local Rules, but the court will consider requests for continuances or extensions of time. Order Implementing Procedures for the Filing of Highly Sensitive Documents
On February 9, 2021, the United States Court of Appeals for the First Circuit issued this order implementing new procedures for the filing of highly sensitive documents.

Public Advisory Concerning the Court's Sitting Schedule
Members of the public may listen to the live audio of oral argument at https://www.youtube.com/channel/UCiq_Kg0zEPrjMFK_s-KP5_g/ or may attend oral arguments in-person. After the end of each day's arguments, audio recordings of each argument will be available on the court's website.
