Order Implementing Procedures for the Filing of Highly Sensitive Documents

On February 9, 2021, the United States Court of Appeals for the First Circuit issued this order implementing new procedures for the filing of highly sensitive documents.

Public Advisory Concerning the Court's Sitting Schedule
The U.S. Court of Appeals for the First Circuit will hold oral arguments by video conference during the court’s March 2021 session. Given the continued public health restrictions and limits on public access to the courthouse, the court will also provide live audio access to such arguments. Public access to live audio of the court’s March 2021 court session will be available at https://www.youtube.com/channel/UCiq_Kg0zEPrjMFK_s-KP5_g/. After the end of each day's arguments, audio recordings of each argument will be available on the court's website. Counsel scheduled for argument during the March 2021 court session will be receiving additional information and instructions from the Clerk’s Office. Notice Regarding Operations of the U.S. Court of Appeals for the First Circuit
Due to the COVID-19 virus pandemic and in order to protect public health and safety, this court is temporarily suspending the requirement in Local Rule 25.0(b)(1)(c) that appendices to briefs must be filed only in paper form. For the duration of this suspension, all parties who are represented by counsel shall tender the appendix electronically, through the court's electronic filing system. After the appendix is accepted for filing, the court may set a deadline for paper copies of the appendix. No other rules, including those relating to the form or substance of an appendix, service requirements, or the handling of appendices to be filed under seal, are impacted by this suspension. Due to health concerns over the COVID-19 virus, the Clerk's Office for the U.S. Court of Appeals for the First Circuit will not accept in-person case filings at its intake window, until further notice. If you plan to file a paper document at the Moakley Courthouse, please use the drop-box located on the first floor by the main entrance. You can reach the Clerk's Office by phone at 617-748-9057.
